1. Acceptance of Terms
By accessing or using FinBox ("the Service"), operated by Novus Labs (Catalyst Innovation Solutions) ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you and Novus Labs (Catalyst Innovation Solutions), a company registered in South Africa. By creating an account or using any part of the Service, you confirm that you are at least 18 years old and legally capable of entering into a binding agreement.
2. Use of Service
FinBox provides a financial document management platform that allows users to capture, organise, and export financial records including invoices, receipts, and business travel logs.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service for any unlawful or fraudulent purpose
- Upload content that infringes any third-party rights
- Attempt to gain unauthorised access to any part of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Reverse-engineer, decompile, or disassemble any part of the Service
- Resell or sublicense access to the Service without our written consent
We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We will endeavour to provide reasonable notice for significant changes.
3. User Data
You retain full ownership of all data you upload to the Service ("User Data"). By uploading User Data, you grant us a limited, non-exclusive licence to process, store, and display your data solely for the purpose of providing the Service.
We do not sell your data to third parties. We process your data in accordance with our Privacy Policy and in compliance with the Protection of Personal Information Act, 4 of 2013 (POPIA).
You are responsible for ensuring that any data you upload complies with applicable laws and does not infringe the rights of any third party. You represent and warrant that you have the right to upload and process all User Data through the Service.
4. Payments and Refunds
FinBox offers both free and paid subscription plans. Paid plans are billed monthly or annually, as specified at the time of purchase. All prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable.
Payments are processed securely via PayFast. We do not store your payment card details. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
Refund policy: We offer a 7-day money-back guarantee on first-time paid plan purchases. Requests must be made within 7 days of the initial charge to support@myfinbox.co. Refunds are not provided for partial subscription periods or for subsequent billing cycles.
5. Termination
You may cancel your account at any time by contacting support@myfinbox.co or via the account deletion option in your settings. Upon cancellation, your access to paid features will continue until the end of the current billing period.
We reserve the right to suspend or terminate your account immediately if you breach these Terms, engage in conduct harmful to other users, or engage in conduct harmful to Novus Labs (Catalyst Innovation Solutions). In such cases, no refund will be provided.
Upon termination, you may request a data export within 30 days. After 30 days, your data may be permanently deleted in accordance with our data retention policy.
6. Limitation of Liability
To the fullest extent permitted by South African law, Novus Labs (Catalyst Innovation Solutions) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to loss of data, loss of revenue, or loss of business opportunity.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to us in the 12 months preceding the claim.
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure, although we take reasonable measures to ensure reliability and security.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
8. Changes to These Terms
We reserve the right to update these Terms at any time. We will notify users of material changes via email or a prominent notice on the Service. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
